Care & service concerns

Home Care Patient Bill of Rights

  • Receive written rights before care begins and exercise those rights.
  • Receive service and charge information, plus oral and written explanations of expected payer coverage and your financial responsibility before care. Changes must be explained promptly, within 30 days after the agency learns of them.
  • Know which services will be provided, when and how, and who provides them.
  • Participate in care planning and hear about changes in advance.
  • Refuse care after understanding the consequences.
  • Know complaint procedures and obtain investigation of care, missing services, or property concerns. Complain or recommend changes through staff, DOH, or a chosen outside representative without interference, coercion, discrimination, or reprisal.
  • Be treated with consideration, dignity, respect, and recognition of individuality.
  • Have confidential records and refuse outside disclosures, subject to transfer, legal, and payment-contract exceptions.
  • Decline advanced tasks by an advanced home health aide; the agency must arrange RN performance when applicable.

A legally authorized representative exercises these rights when a patient lacks capacity.

This summary does not replace the written rights and financial notices provided before care.
